EB-1
(EB-1A GREEN CARDS)

You may be eligible for this visa if you are a noncitizen of “extraordinary ability.” The requirements are:

Evidence

You must  demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim.

You must meet at least 3 of the 10 criteria* below, or provide evidence of a one-time achievement (i.e., Pulitzer, Oscar, Olympic Medal) as well as evidence showing that you will be continuing to work in the area of your expertise

* Criteria for Demonstrating Extraordinary Ability

To demonstrate you have sustained national or international acclaim and  your achievements have been recognized in your field, you must either include evidence of a one-time achievement (major internationally-recognized award) or meet 3 of the 10 listed criteria below :

  • Evidence of receipt of lesser nationally or internationally recognized prizes or awards for excellence
  • Evidence of your membership in associations in the field which demand outstanding achievement of their members
  • Evidence of published material about you in professional or major trade publications or other major media
  • Evidence that you have been asked to judge the work of others, either individually or on a panel
  • Evidence of your original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field
  • Evidence of your authorship of scholarly articles in professional or major trade publications or other major media
  • Evidence that your work has been displayed at artistic exhibitions or showcases
  • Evidence of your performance of a leading or critical role in distinguished organizations
  • Evidence that you command a high salary or other significantly high remuneration in relation to others in the field
  • Evidence of your commercial successes in the performing arts

GREEN CARDS

Step 1: Are You Eligible?

To qualify for an EB-2 visa, you must meet 1 of the following 2 criteria:

  1. You have an advanced degree (Master’s or Ph.D Degree), or its equivalent (Bachelor’s Degree and 5 years of experience); or
  2. You have demonstrated exceptional ability in your field.

Most applicants easily pass the General EB-2 Eligibility Test by having an advanced degree or its equivalent. 

Step 2: The National Interest Waiver Test

After passing the General EB-2 Eligibility Test, you must also satisfy all 3 elements of the National Interest Waiver test, which are:

  1. Your proposed work has both substantial merit and national importance;
  2. You are well-positioned to advance your proposed work; and
  3. When balancing all the factors, it would be in the national interest of the U.S. to grant you a waiver of the normal job and labor certification requirements.

EB-3
GREEN CARDS

You may be eligible for this immigrant visa if you are an “unskilled worker.”

• You must demonstrate the ability to perform unskilled labor (requiring less than 2 years training or experience), that is not of a temporary or seasonal nature.

• You must be performing work for which qualified workers are not available in the United States.

• You must meet any other requirements specified on the labor certification.

Labor certification and a permanent, full-time job offer required.

GREEN CARDS

Immigrant Investor Program

Under this program, investors (and their spouses and unmarried children under 21) are eligible to apply for a Green Card (permanent residence) if they:

  • Make the necessary investment (usually $800,000) in a commercial enterprise in the United States; and
  • Plan to create or preserve 10 permanent full-time jobs for qualified U.S. workers. 

 

Congress created the EB-5 Program in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors.
